1. Agreement
These Terms of Service (“Terms”) govern access to and use of the CheckoutGuard application (“App”) operated under the Shopify Partner account associated with Formhouseai (“Provider”, “we”, “us”) for merchants using Shopify (“Merchant”, “you”).
By installing or using the App, you agree to these Terms. If you do not agree, do not install or use the App.
2. Service description
CheckoutGuard helps Merchants:
- Monitor order patterns associated with automated checkout abuse and card-testing-style activity using heuristic analytics; and
- Optionally configure checkout validation rules executed by Shopify’s platform (Shield Mode and related protections).
The App does not guarantee fraud prevention, chargeback protection, detection of stolen cards, or uninterrupted blocking of abusive traffic. Protections are limited to signals and APIs Shopify exposes to the App and to your configured rules.
3. Plans and features
Feature access depends on your active plan. Plan names and entitlements may include:
- Monitor (Free) — monitoring, basic alerts, dashboard, limited history; no checkout blocking
- Protect — Shield Mode, protection rules, email alerts, extended history
- Pro — advanced incident tools, longer history, Emergency Shield presets, and priority alerting features as described in the App
Exact features, prices, and history windows are shown in the App’s Plan page and may change with notice as permitted by Shopify.
4. Relationship with Shopify
The App is provided via the Shopify platform. Shopify is not a party to these Terms. Your use of Shopify remains subject to Shopify’s terms and policies. Availability of the App depends on Shopify APIs, billing, and Function / validation infrastructure.
5. Merchant responsibilities
You agree to:
- Review rules carefully before enabling Shield Mode (default is Monitor Mode with no checkout blocking)
- Ensure geographic, buyer, product, or quantity restrictions are lawful for your store and jurisdiction
- Treat alerts and scores as heuristic signals, not definitive fraud findings
- Comply with applicable laws and Shopify policies
- Maintain accurate billing and contact information
You are responsible for false positives (legitimate customers blocked) when Shield Mode and rules are enabled.
6. Acceptable use
You may not:
- Reverse engineer the App except as permitted by law
- Use the App to violate Shopify policies or applicable law
- Attempt to access other merchants’ data
- Interfere with service integrity, rate limits, or security controls
7. Data and privacy
Processing of personal data is described in our Privacy Policy. You represent that you have a lawful basis to process buyer data and to appoint us as processor where applicable.
8. Fees and billing
Paid plans are billed through Shopify’s billing system (Shopify App Pricing) unless otherwise stated. Fees are non-refundable except where required by law or Shopify policy. Free Monitor features remain available without checkout blocking, subject to these Terms.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE”. TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CheckoutGuard is not a payment security certification, PCI compliance shortcut, insurance product, or legal determination of fraud.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROVIDER WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, REVENUE, GOODWILL, OR DATA — INCLUDING DAMAGES ARISING FROM CHARGEBACKS, BLOCKED CHECKOUTS, OR MISSED ATTACKS.
PROVIDER’S TOTAL LIABILITY FOR CLAIMS ARISING FROM THE APP IN ANY TWELVE (12) MONTH PERIOD WILL NOT EXCEED THE FEES YOU PAID FOR THE APP THROUGH SHOPIFY IN THAT PERIOD (OR ONE HUNDRED U.S. DOLLARS IF NO FEES WERE PAID), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations; in those cases, limits apply to the fullest extent permitted.
11. Indemnity
You will indemnify Provider against claims arising from your store content, rule configuration, misuse of the App, or violation of these Terms, except to the extent caused by Provider’s gross negligence or willful misconduct.
12. Suspension and termination
You may uninstall the App at any time. We may suspend or terminate access for material breach, risk to the platform, or legal requirement. Provisions that by nature should survive (including disclaimers, liability limits, and indemnity) survive termination.
13. Changes
We may modify these Terms or the App. Material changes will be posted with an updated “Last updated” date on this page. Continued use after changes constitutes acceptance where permitted by law.
